Father’s Day Fishing Competition – Ts and Cs

These terms and conditions apply to the “Frogfoot Father’s Day Fishing Competition”, a competition conducted by Frogfoot Networks (Pty) Ltd (“Frogfoot”). By entering this competition, you agree to be bound by the competition rules below.

1. Eligibility and Entry
1.1 This competition will run from 07:00 to 14:00 on the 18th of June 2022 (the “Competition Period”) at Amanzimtoti Beach, Durban, Kwazulu-Natal, South Africa.
1.2 Teams consisting of one dad and one or more children may enter (each being a “Team”).
1.3 To qualify to enter this competition, the Team members must meet the following criteria (the “Eligibility Criteria”):
1.3.1 One team member must be considered, in Frogfoot’s discretion, to be a father (the “Father”) and must:
a) be 18 years or older;
b) be a citizen of, and reside lawfully in, the Republic of South Africa during the Competition Period;
c) have a valid South African identity document (”ID”);
d) be the parent or guardian each minor child forming part of the Team, or have the written consent of the parent or guardian of such child(ren) that they may take part in this competition;
e) reside within a geographical area covered by the Frogfoot network which can be determined online at www.bit.ly/3GMeZqy; and
1.3.2 each child must:
a) either be under 18 years of age; or
b) if under the age of 18, have the consent of their parent or guardian to participate in this competition; and
1.3.3 none of the members of the Team may be:
an employee, director, member, partner, agent, independent contractor or consultant of Frogfoot or an immediate family member of any of these, where the term “immediate family member” means a spouse, parent, sibling, grandparent, child or grandchild.
1.4 The entry fee is R100 (one hundred rand) per Team (the “Entry Fee”) all of which will be donated to the charity, Mother of Peace in Illovo. For more information regarding this charity, you can go to https://motherofpeace.org.za.

2. Competition Rules
2.1 To enter this competition, take part in the fishing and be eligible for any of the prizes the Team must, during the Competition Period:
2.1.1 meet all of the Eligibility Criteria set out in clause 1.3 and its subclauses;
2.1.2 accurately complete the registration form at the Frogfoot activation stand (the “Entry Form”);
2.1.3 record and submit, amongst other information, their full names and ID numbers on with the Entry Form;
2.1.4 pay the Entry Fee;
2.1.5 go fishing from the beach at Amanzimtoti Beach using their own fishing tackle and bait; and
2.1.6 present the Team’s catch to the Frogfoot officials at the end of the Competition Period.
2.2 By the action of submitting the Entry Form, the Father agrees and consents on his own behalf and on behalf of the other members of the Team to:
2.2.1 being bound by these Competition Terms and Conditions;
2.2.2 receiving marketing materials now and in the future from Frogfoot relating to promotions, specials and product releases of Frogfoot’s products and services, it being understood that each Team member can withdraw such consent at any time; and
2.2.3 their personal information being collected and processed by Frogfoot subject to the conditions set out in clause 5 below.
2.3 Incomplete, inaccurate, incorrect, or incomprehensible Entry Forms will be deemed invalid and be disqualified.
2.4 In the event of a dispute in respect of any aspect of this competition, Frogfoot’s decision is final and binding and no correspondence will be entered into.

3. HOW TO WIN
3.1 The Team that meets the following criteria (“Category”) will win a prize:
3.1.1 Biggest Fish (length);
3.1.2 Prince Toby – most Toby caught on the day;
3.1.3 Most fish caught; and
3.1.4 Catch of the day (most rare or unique).
3.2 The Lucky Draw will take place at 14:00 on Saturday 18 June 2022.
3.3 Frogfoot will, in its sole discretion, determine the winner of each Category. Once each winning Team has been selected, the Entry Form will be checked to ensure that the requirements stipulated in clauses 1.2 and 1.3 are met. Should any of these requirements not be met, the winning Team will be disqualified, and a second runner up for that category will be selected by Frogfoot.
3.4 One Team can win more than one category.
3.5 Once the winning Teams have been determined:
3.5.1 they will be announced at the event as well as on Frogfoot’s social media pages; and
3.5.2 prizes will immediately be awarded at the event.

4. THE PRIZES
4.1 The Prizes are as follows:
Category Prize
– Biggest Fish R1000 voucher to a fishing shop
– Family that catches the most fish R2 500 voucher (accommodation)
– Prince Toby R250 Voucher (Galleria Shopping Mall)
– Catch of the day R250 Voucher (Galleria Shopping Mall)
4.2 Frogfoot reserves the right to substitute any of the prizes with any other prize(s) of equal value, in its sole and absolute discretion.
4.3 The prizes cannot be exchanged for cash.
4.4 The winning Teams are responsible for paying for all incidental expenses, including income tax, that may be incurred by them, in accepting and using the prizes.

5. PERSONAL DATA AND PRIVACY
5.1 When completing the Entry Form, each member of the Team will be asked to provide their full names, phone number, e-mail address, age and other information that may constitute personal information (“Personal Information”) and, in respect of each minor child, special personal information (“Special Personal Information”) as defined in the Protection of Personal Information Act 4 of 2013 (the “POPI Act”).

5.2 By submitting an Entry Form to enter this competition, and subject to the provisions of the POPI Act, the Father:
5.2.1 on his own behalf and on behalf of each of the other team members, agrees that Frogfoot may, and expressly authorises Frogfoot to, collect, store and use their Personal Information and Special Personal Information to:
a) enable them to participate in the Competition and collect the prize should their Entry Form be drawn as the Winner; and
b) market and promote its own goods and services to the Entrant;
5.2.2 warrants that he has secured the necessary consent from the parent or guardian of the minor children member of the Team.

6. PUBLICITY
6.1 Subject to their right, at any time, to subsequently decline, the Father on his own behalf and on behalf of each member of the Team, agrees that the Team members may be identified by name and surname, and their photograph(s) taken and published in all of Frogfoot’s online and/or social media for an indefinite period.

7. DISCLAIMER
7.1 Frogfoot reserves the right to cancel this competition or amend these Competition Terms and Conditions, including but not limited to the duration of the Competition Period, and Entrants will have no recourse against Frogfoot.
7.2 All members of the Team enter and take part in the competition at their own risk and Frogfoot bears no responsibility for any loss, damage or harm suffered as a result of participation in this competition or acceptance of the prizes.
7.3 To the maximum extent permitted in law, Frogfoot and its affiliate companies are not liable for:
7.3.1 any defects in any of the prizes; and/or
7.3.2 any harm suffered by the winning Teams in taking up and using such prizes.
